Overview
This website is operated by Josepht Shoe Artisan, a shoe retailer based in Canada shipping internationally from South Korea. Throughout the site, the terms "we", "us" and "our" refer to Josepht Shoe Artisan.
By visiting our site and/or purchasing from us, you agree to be bound by these Terms of Service, including all policies referenced herein. These Terms apply to all users of the site including browsers, customers, and vendors. Please read them carefully before making a purchase.
Our store is hosted on Shopify Inc., which provides our e-commerce platform. Any new features or tools added to our store shall also be subject to these Terms. We reserve the right to update these Terms at any time by posting changes to this page.
Section 1 — Online Store Terms
By agreeing to these Terms of Service, you represent that you are at least the age of majority in your province or territory of residence, or that you have given consent for any minor dependents to use this site.
You may not use our products for any illegal or unauthorized purpose, nor may you violate any laws in your jurisdiction — including copyright laws — in the course of using our Service.
A breach or violation of any of these Terms will result in immediate termination of your access to our Services.
Section 2 — General Conditions
We reserve the right to refuse service to anyone for any reason at any time.
You understand that your content (not including payment information) may be transmitted over various networks and adapted to meet technical requirements of connecting networks or devices. All payment information is processed securely through Shopify Payments and is encrypted during transmission. We do not store your full payment details on our servers.
You agree not to reproduce, duplicate, copy, sell, resell, or exploit any portion of the Service without express written permission by us.
Section 3 — Accuracy, Completeness and Timelines of Information
We make every effort to ensure product descriptions, pricing, and availability information on this site are accurate and current. However, we do not guarantee that all information is complete or error-free at all times.
Our inventory is updated weekly. As a result, product availability may change between the time you place your order and the time it is processed. In the event an item is confirmed as out of stock when we receive it, we will contact you promptly. You may cancel for a full 100% refund, wait for restock (typically 4–6 weeks, restock dates not always guaranteed), or exchange for an available item with any price difference charged or refunded accordingly. If we do not hear back within 7 days, a full refund will be issued automatically.
We reserve the right to modify the contents of this site at any time without notice. It is your responsibility to check for updates. Any reliance on information on this site is at your own risk.
Section 4 — Modifications to the Service and Prices
Prices for our products are subject to change without notice. We reserve the right to modify or discontinue the Service (or any part or content thereof) at any time without notice.
Promotional pricing, discount codes, and limited-time offers are subject to availability and may be withdrawn at any time. Items purchased during a promotional sale are subject to our Promotional Sale terms as outlined in our Refund Policy.
We shall not be liable to you or to any third party for any modification, price change, suspension, or discontinuance of the Service.
Section 5 — Products and Services
All products sold on this site are shipped internationally from South Korea. By placing an order, you acknowledge that delivery timelines, shipping carriers, and associated costs are subject to our Shipping & Return Policy, available at josepht.ca/pages/shipping-return.
Product Availability
Certain products may have limited quantities. Our inventory is updated weekly, and availability is not guaranteed until your order has been confirmed and processed. In the event an item is confirmed as out of stock, we will contact you promptly with the same options: full refund, wait for restock, or exchange for an available item.
Returns & Exchanges
All returns and exchanges are subject to the conditions outlined in our Refund Policy (josepht.ca/policies/refund-policy) and Shipping & Return Policy (josepht.ca/pages/shipping-return). Key conditions include:
- Returns must be requested within 20 days of delivery
- Items must be unworn, undamaged, and in original packaging
- Refunds are subject to a deduction of USD $45 (first request) or USD $65 (subsequent requests)
- Items purchased with promotions exceeding 20% off are final sale and non-refundable
Note: All fees and deductions are stated in USD. If your order was placed in a different currency (CAD, AUD, EUR, etc.), the equivalent amount will be charged or deducted at the prevailing exchange rate at the time of transaction.
Goodyear Welted Collections
The following collections are not eligible for exchange under any circumstances due to the nature of their construction: Jutta Series, JosephT Series, Luxy Series, and Noir Boots. Refunds remain available under standard return conditions. The 6-month manufacturing defect warranty applies to all collections including these.
Important: If you are ordering from any Goodyear Welted collection, we strongly urge you to contact us about sizing before purchasing at info@josepht.ca, as size exchanges will not be possible after your order is placed.
Product Warranty
All products are covered by a 6-month warranty from the date of delivery against manufacturing defects including material, stitching, and sole separation issues. Warranty claims require both photo and video evidence and must be submitted to info@josepht.ca within the warranty period. Resolution may include repair, replacement, refund, or cobbler reimbursement at our discretion. Cobbler reimbursements require prior approval, a proper receipt from the cobbler (including business name, contact details, and itemised cost), and at least one photo of the shoe being repaired. We reimburse based on the nature of the repair, with a general guideline of up to USD $80 for most cases.
Color Accuracy
We make every effort to display product colors accurately. However, color representation may vary depending on your screen settings and device. This does not constitute grounds for a return under our defective items policy.
Delivery Responsibility
We are responsible for your order from the moment it leaves our facility in Korea until it arrives in your destination country. Once your package has been handed to your local courier in your country, responsibility transfers to you as the recipient. Once a package is marked as delivered by your local courier, we cannot be held responsible. Delivery confirmation is considered proof that the package reached your address.
Shipping Notifications
Once your order has been confirmed as shipped, you will receive two separate notifications: (1) an automated Shopify email containing your tracking number, and (2) a manual email from info@josepht.ca sent within 24 hours of shipment confirmation. Both notifications are sent to the email address provided at checkout.
Section 6 — Accuracy of Billing and Account Information
We reserve the right to refuse any order at our sole discretion. We may limit or cancel quantities purchased per person, per household, or per order. In the event we modify or cancel an order, we will attempt to notify you using the email address provided at the time of purchase.
You agree to provide current, complete, and accurate purchase and account information for all orders. Providing an incorrect shipping address that results in a failed or returned delivery is the responsibility of the customer.
Section 7 — Optional Tools
We may provide access to third-party tools and services, including but not limited to Shopify and Loop (our returns management system). These tools are provided "as is" without any warranties or endorsement from us. Use of any third-party tool is entirely at your own risk and subject to that provider's own terms and conditions.
Section 8 — Third-Party Links
Our site may contain links to third-party websites not affiliated with us. We are not responsible for the content, accuracy, or practices of any third-party site. Any transactions made through third-party websites are solely between you and that third party. We are not liable for any harm or damages related to purchases made through third-party websites.
Section 9 — Customer Feedback and Submissions
If you submit feedback, reviews, suggestions, or other communications to us, you agree that we may use, reproduce, and publish such content without restriction or compensation to you.
Dispute Resolution Before Public Review
If you experience an issue with your order, you must contact us at info@josepht.ca before posting a public review. Please note:
- Any public review containing false or misleading claims — including claims that we refused to resolve an issue when no prior contact was made — will be considered a material breach of these Terms
- Posting such a review before contacting us, or while a resolution is actively in progress, may result in the forfeiture of any refund, return, or reimbursement that would otherwise apply
- We reserve the right to dispute, respond to, or seek removal of any review that contains demonstrably false statements about our business or conduct
We welcome honest feedback and do not penalize customers for legitimate negative reviews posted after a good-faith resolution attempt has been made with us directly.
Section 10 — Personal Information
Your submission of personal information through our store is governed by our Privacy Policy. As a Canadian business, we handle personal information in accordance with PIPEDA and applicable provincial privacy laws. Section 11 — Errors, Inaccuracies and Omissions
Occasionally there may be information on our site that contains typographical errors, inaccuracies, or omissions. We reserve the right to correct any such errors and to update or cancel orders if information is found to be inaccurate, at any time without prior notice.
Section 12 — Prohibited Uses
In addition to other prohibitions set out in these Terms, you are prohibited from using this site or its content for any of the following:
- Any unlawful purpose or to solicit others to perform unlawful acts
- Violating any international, federal, provincial, or local laws or regulations
- Infringing upon our intellectual property rights or those of any third party
- Harassing, abusing, insulting, harming, defaming, or discriminating against any person
- Submitting false, misleading, or fraudulent information — including false claims in support of a chargeback, dispute, or refund request
- Uploading or transmitting viruses or any malicious code
- Spamming, phishing, scraping, or any other unauthorized data collection
- Interfering with or circumventing the security features of this site
Fraudulent Disputes & Chargebacks
Filing a chargeback or payment dispute with your bank or credit card provider without first attempting to resolve the issue directly with us constitutes a prohibited use of our Service. We maintain detailed records of all orders, communications, and shipping activity. Customers found to have filed fraudulent or bad-faith disputes may be permanently banned from purchasing through our store.
Section 13 — Disclaimer of Warranties and Limitation of Liability
We do not guarantee that your use of our service will be uninterrupted, timely, secure, or error-free. All products and services are provided "as is" and "as available" without any representation, warranties, or conditions of any kind.
To the maximum extent permitted by the laws of the Province of British Columbia, Josepht Shoe Artisan shall not be liable for any indirect, incidental, punitive, special, or consequential damages of any kind, including loss of profits, revenue, data, or business opportunity. Our liability shall be limited to the lesser of: (a) the original purchase price of the product giving rise to the claim, or (b) the cost of replacing or repairing the product.
Section 14 — Indemnification
You agree to indemnify, defend, and hold harmless Josepht Shoe Artisan and its directors, officers, employees, affiliates, agents, contractors, suppliers, and service providers from any claim, demand, loss, damage, or expense arising out of or relating to your breach of these Terms, your violation of any applicable law or regulation, or any false, misleading, or fraudulent information you provide to us.
Section 15 — Severability
If any provision of these Terms of Service is found to be unlawful, void, or unenforceable, that provision shall be enforced to the fullest extent permitted and the unenforceable portion shall be deemed severed from these Terms. Such a determination shall not affect the validity or enforceability of any remaining provisions.
Section 16 — Termination
These Terms of Service are effective unless and until terminated by either you or us. If, in our sole judgment, you fail to comply with any provision of these Terms, we may terminate this agreement at any time without notice. Upon termination you will remain liable for all amounts due up to and including the date of termination.
Section 17 — Entire Agreement
These Terms of Service, together with our Shipping & Return Policy and Refund Policy, constitute the entire agreement between you and us regarding your use of our Service. They supersede all prior agreements, communications, and proposals between you and us.
Section 18 — Governing Law
These Terms of Service shall be governed by and construed in accordance with the laws of the Province of British Columbia and the federal laws of Canada applicable therein. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of British Columbia, Canada.
Section 19 — Changes to Terms of Service
We reserve the right to update, change, or replace any part of these Terms of Service at our sole discretion by posting updates to this page. Your continued use of our website following the posting of any changes constitutes your acceptance of those changes.
